The services of the National Mediation Board (NMB) were invoked by the CCAir Pilots Association (CCPA) on November 13, 2001, to investigate and determine who may represent for the purposes of the Railway Labor Act, as provided by Section 2, Ninth, thereof, personnel described as "Flight Deck Crew Members," employees of CCAir, Inc.

At the time this application was received, these employees were represented by the Air Line Pilots Association.

The Board assigned Investigator Sean J. Rogers to investigate.

Subsequently, Mark K. Kaufman, Chairman of CCPA filed a letter with the NMB which stated, "This letter is to advise you that, on behalf of the CCAir Pilots Association, I am hereby withdrawing the application for an investigation of a representation dispute, and request for an election at CCAir, Inc. filed in November 2001."

On the basis of this letter of withdrawal referred to above, the Board hereby dismisses the application and closes its file subject to Part 1206.4(b) of the NMB Rules.
