The services of the National Mediation Board were invoked by Timothy W. Short, an Individual on June 7, 2001, to investigate and determine who may represent for the purposes of the Railway Labor Act, as provided by Section 2, Ninth, thereof, personnel described as "Trainmen/Conductor/Engineer," employees of CSX Transportation Inc.


At the time this application was received, these employees were represented by the United Transportation Union and the Brotherhood of Locomotive Engineers.


The Board assigned Investigator Mary L. Johnson to investigate.


FINDINGS



The Investigator's investigation established that the organization had failed to support its application with the required number of authorizations from the employees in the craft or class as set forth in Part 1206.2(a) of the National Mediation Board Rules.


Therefore, the Board finds no basis upon which to proceed in this matter, and NMB File No. CR-6724 is converted to NMB Case No. R-6837 and the Board hereby dismisses the application and closes its file in this matter.
