    The services of the National Mediation Board (NMB) were invoked by the Brotherhood of Maintenance of Way Employes on September 8, 1998, to investigate and determine who may represent for the purposes of the Railway Labor Act, as provided by Section 2, Ninth, thereof, personnel described as “Maintenance of Way Employees,” employees of   “the” Delaware-Lackawanna Railroad Company, Inc.

    At the time this application was received, these employees were not represented by any organization or individual.

    The Board assigned Mediator   Sean J. Rogers to investigate.

    Subsequently, Donald F. Griffin, Assistant General Counsel of the Brotherhood of Maintenance of Way Employes filed a letter dated October 9, 1998, which stated, in part, “[the] BMWE respectfully requests leave to amend its original applications seeking representation in five (5) classes or crafts to an application seeking representation of the single craft or class of ‘Operating/Non-Operating Employees.’” Since NMB Case No. R-6625 has been amended to cover the craft or class of “Operating/Non-Operating Employees,” this case has been withdrawn.


    On the basis of this letter referred to above, the Board hereby dismisses the application and closed its file subject to Part 1206.4 of the NMB Rules.
